Welcome to Webco Talent, a service provided by Webchoice Online Pty Ltd (ABN 29 134 962 922) trading as Webco Talent (“Webco Talent”, “we”, “us” or “our”). By engaging with our services, you agree to the following terms and conditions. These Terms of Service (“Terms”) govern the use of our professional, managed, and offshore staffing services provided through direct engagement and contractual agreements.
 

• Service Overview Webco Talent provides professional services, including but not limited to offshore staffing solutions, software development, and managed services. These services are delivered under individual contracts negotiated and signed with each client, which take precedence over any terms outlined here in the event of conflict.

• Contractual Engagement All service engagements with Webco Talent are formalised through a signed contract that outlines the specific scope, deliverables, pricing, terms, and conditions unique to each client. These contracts may contain additional or overriding terms to those found in this general Terms of Service.

• Payment Terms Clients are invoiced in accordance with the terms outlined in their service agreement. Payment is due via bank transfer to the account details provided on the invoice. No subscriptions or self-service payment facilities are offered through our website.

• Refunds and Cancellations Refunds, cancellations, and billing policies are governed by the specific service agreement signed with each client. These policies vary depending on the nature of services provided and client requirements.

1. 1. Client Responsibilities Clients are responsible for:
      • • Providing timely access to systems, tools, and personnel required for project execution.
        • Meeting payment deadlines as per the agreed terms.
        • Ensuring any confidential information shared with Webco Talent is clearly identified and protected accordingly.

1. Confidentiality We treat all client data and communications as confidential and will only use such information for the purposes of delivering services under our agreement. More detailed confidentiality clauses will be contained in the individual contract.
 
2. Limitation of Liability To the extent permitted by law, Webco Talent will not be liable for any indirect, incidental, special, or consequential loss or damage resulting from the use or inability to use our services, except as required by Victorian or Australian consumer law.
 
3. Governing Law These Terms are governed by and construed in accordance with the laws of the State of Victoria, Australia. Any disputes will be handled under Victorian jurisdiction, unless otherwise stated in a client contract.
 
4. Updates to These Terms These Terms of Service may be updated from time to time. Any material changes will be communicated through email or other client communication channels. Continued use of our services after such updates constitutes your acceptance of the revised terms.
